OCC Computer Personnel – Privacy Notice

OCC Computer Personnel (OCC) is a recruitment company. We provide work-finding services for temporary and permanent workers together with search and selection services to our Clients. OCC must process personal data (including sensitive personal data) so that it can provide these services – in doing so, the Company acts as a data controller. As defined in the General data Protection Regulation (GDPR) EU 2016/679.

OCC is committed to the protection of your data in accordance with this policy and associated legislation.

You may give your personal details to OCC directly, such as on an application or registration form or via our website, or we may collect them from another source such as a jobboard. OCC must have a legal basis for processing your personal data. For the purposes of providing you with work-finding services and/or information relating to roles relevant to you we will only use your personal data in accordance with the terms of the following statement.

1. Collection and Use of Personal Data

a. Purpose of processing and legal basis

OCC will collect your personal data (which may include sensitive personal data) and will process this data for the purposes of providing you with work-finding services. The legal basis we rely upon to retain this information, may be one of the following:

  • Your direct consent
  • Our legitimate business interests
  • Our legal obligation
  • A contractual obligation

b. Categories of data

The personal data we collect may include:

  • Name, contact details, employment history, immigration status, salary/rate expectation or any additional information supplied by you.
  • Information supplied on 3rd party websites such as LinkedIn and job boards.

Where appropriate & only in accordance with your direct consent, we may collect additional or sensitive personal data, such as:

  • Criminal convictions
  • Information relating to diversity or references.

c. Recipient/s of data

OCC will process your personal data and/or sensitive personal data with the clients, only upon your approval.

2. Overseas Transfers

OCC may transfer only the information you provide to us to countries outside the European Economic Area (“EEA”) for the purposes of providing you with work-finding services. We will take steps to ensure adequate protections are in place to ensure the security of your information. The EEA comprises the EU member states plus Norway, Iceland and Liechtenstein.

3. Data Retention

OCC will retain your personal data only for as long as is appropriate to our legitimate business interest. We therefore will retain your CV & associated contact record for a period of 3 years from the date of last contact.

Where OCC has obtained your consent to process your personal or sensitive data, we will do so in line with our retention policy (3 years). Upon expiry of that period OCC will seek further consent from you. Where consent is not granted OCC will cease to process your personal or sensitive data.

We must also keep your payroll records, holiday pay, sick pay and pensions auto-enrolment records associated national minimum wage, social security and tax legislation for as long as is legally required by HMRC. (6 years)

We must retain any information relating to health & safety regulations for a period of 40 years.

4. Data Sharing

Access to your personal data is limited to those OCC employees whose roles require such. Your data is not shared with any 3rd party unless you have provided specific consent for us to do so, with the exclusion of regulatory compliance whereby that provision is mandatory in law .e.g. HMRC.

5. Your Rights

Please be aware that you have the following data protection rights:

  • The right to be informed about the personal data OCC processes on you;
  • The right of access to the personal data OCC processes on you;
  • The right to rectification of your personal data;
  • The right to erasure of your personal data in certain circumstances;
  • The right to restrict processing of your personal data;
  • The right to data portability in certain circumstances;
  • The right to object to the processing of your personal data that was based on a public or legitimate interest;
  • The right not to be subjected to automated decision making and profiling; and
  • The right to withdraw consent at any time.
